Terms of Use — PhysiqueMax
DRAFT for legal review. Not legal advice. Review by a German lawyer (consumer + app law) before launch.
Provider: Blocksize One UG (haftungsbeschränkt), Oberstr. 3, 47829 Krefeld, Germany (“we”). See /impressum.
1. Service
PhysiqueMax generates AI-predicted images of your physique after 30 to 90 days of training (and further milestones you can unlock) based on photos you upload, and provides progress-photo comparison and training guidance.
2. No guarantee of results — no medical advice
Predictions are computer-generated estimates for motivation. They are not a promise of results. Actual outcomes depend on your training, nutrition, sleep and genetics. The app provides no medical advice, diagnosis or treatment. Consult a doctor before starting training, especially with pre-existing conditions.
3. Subscriptions
- Free download includes the initial scan and a preview.
- Auto-renewing subscriptions via Apple In-App Purchase: €3.99/week or €49.99/year (prices incl. VAT; the price shown in the App Store at purchase applies).
- Renewal charges within 24h before period end. Manage/cancel: App Store → Subscriptions. Cancellation stops renewal; the current period stays active.
- Right of withdrawal (EU): you have 14 days to withdraw from a digital-content purchase. When you request immediate access, you consent to immediate performance and acknowledge loss of the withdrawal right per § 356 Abs. 5 BGB / Art. 16(m) Consumer Rights Directive. Apple handles refunds for App Store purchases.
4. Your content
You keep all rights to your photos. You grant us a limited license to process them solely to provide the service. You must only upload photos of yourself, and you must be 18 or older. Uploading photos of any other person, or of anyone under 18, is prohibited and leads to permanent exclusion from the service.
5. Acceptable use
Nude photos are prohibited. Photos must show you in athletic clothing (shorts; sports bra where applicable). The app blocks and deletes photos that violate this rule. Further prohibited: uploading photos of any other person without their consent, unlawful content, and attempts to reverse-engineer or scrape the service.
6. Liability
We are liable without limitation for intent and gross negligence and under the Produkthaftungsgesetz. For slight negligence, liability is limited to breach of essential contractual duties (Kardinalpflichten) and capped at foreseeable, typical damage.
7. Governing law
German law. Mandatory consumer protections of your residence remain unaffected. EU ODR platform: https://ec.europa.eu/consumers/odr — we do not participate in consumer arbitration.
8. Changes
We may amend these terms with in-app notice; continued use after notice constitutes acceptance where legally permitted.
